Liability
on employers for personal injury claims is almost absolute,
i.e. it is extremely difficult for employers to defend against
such claims, be they bogus or bona fida.
There is a profusion of statutory requirements placed upon employers
and if they are found to be in breach of any of this law, there
is little defence in subsequent claims of negligence.
Whilst the proliferation of Statutory requirements appear insurmountable,
some simple processes implemented by the employer can give them
the foundation of a defence in most claims against them.
JGMA have developed specific systems of defence over the years,
based upon judgements made through the courts and whilst they
cannot guarantee success in each defence case, it does allow
the defence legal team to operate on a level playing field with
the plaintiff's.
